The Challenge
Built-form scale, equitable development and managing interfaces were challenges due to the remnant Design and Development Overlay provision that counter-posed the emerging built-form character in the context of the City North Structure Plan.
PPP's Outcome
After an initial Council Notice of Refusal this complex case involving many independent expert witnesses was taken to VCAT. After evidence on the issues of height, amenity impacts and sensitive interfaces the Tribunal determined to issue a planning permit without changes to the initial proposal.
